6. Subsequent to the hearing being closed, a reconsideration and recirculation of the MND was ordered to add mitigation measures regarding the Haul Route for the export of earth but the reconsidered MND was not circulated to all the persons who had appeared at the hearing on the Coastal Permit or to persons who subsequently had notified the Zoning Administrator requesting notice, as is required by law. Nor was the hearing reopened as required by law to consider the reconsidered MND.

Summary
